Michigan Right to Life won an injunction this week against the enforcement of a civil rights law that the organization says would force it to hire pro-abortion employees.

Michigan Right to Life claimed that changes to Michigan’s Elliot-Larsen Civil Rights Act could have had a significant impact on its hiring decisions, and the organization stated that the injunction “reaffirms” its right to free association.

“The court’s decision is a welcome reprieve and reaffirms our fundamental right to hire employees who agree with our life-affirming mission. Any attempt by state officials to force organizations like Right to Life of Michigan to employ staff who do not agree with our fundamental mission is a wild misuse of power and defies common sense,” Amber Roseboom, president of Right to Life of Michigan, said in a statement.

The injunction also allows the organization’s Pregnancy Resource Center in Grand Rapids to decline volunteers who do not align with the organization’s mission, and to offer insurance that does not cover elective abortions.

In its lawsuit against the state of Michigan, Right to Life stated that the changes to the state’s employment law would “force religious and pro-life groups to employ and associate with persons who do not share or live by – and may even oppose – the organizations’ beliefs on human life.”

Michigan Attorney General Dana Nessel argued that the law does not present a “realistic enforcement threat” to Right to Life of Michigan, but Judge Robert Jonker disagreed with the state’s assessment.

“The recent statutory changes do, however, at least arguably cover Plaintiffs’ constitutionally protected conduct”, Jonker said in his decision granting the injunction and rejecting the state’s motion to dismiss the lawsuit.
